Welcome to FORMA LABS, an app developed and operated by FORMA LABS LLC ("FORMA LABS", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the FORMA LABS mobile application and related services (collectively, the "Service"). By creating an account, downloading the app, or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
FORMA LABS is intended for users 18 years of age and older. Users under 18 may only access FORMA LABS through a Family Plan account established and supervised by a parent or legal guardian who has accepted the FORMA Liability Acknowledgment. FORMA LABS is not available to users under 13 years of age. By creating or using a FORMA LABS account, you represent that you meet these age requirements. Residents of the European Economic Area must additionally be at least 16, or the applicable minimum age under local law, and the same Family Plan supervision requirements apply for those aged 16–17 in the EEA.
FORMA LABS provides fitness coaching, workout planning, nutrition guidance, AI-powered recommendations, and habit-tracking tools. The Service is intended for general wellness and educational purposes only. It is not a substitute for professional medical, nutritional, psychological, or fitness advice, diagnosis, or treatment.
Consult a qualified physician before beginning any exercise program, changing your diet, or acting on any information provided by the Service. Stop using the Service and seek immediate medical attention if you experience pain, dizziness, shortness of breath, or any other symptom of concern. You assume all risks associated with exercise and dietary changes.
FORMA LABS is not a medical provider, licensed dietitian, therapist, or personal trainer. Our AI coaching features ("Workout Genie" and related tools) generate responses using large language models; those responses are not reviewed by a human professional and may contain inaccuracies.
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly at legal@formaapp.co or via in-app support if you suspect unauthorized access. You may close your account at any time from within the app (Settings → Delete Account) or by contacting us through in-app support.
Some features require a paid subscription. Subscriptions are offered through the Apple App Store and are billed to your Apple ID. Subscription fees, trial terms, and renewal schedules are shown at the point of purchase.
Auto-renewal. Subscriptions automatically renew for the same period and price unless you cancel at least 24 hours before the end of the current period. You can manage and cancel subscriptions at any time in your Apple ID account settings.
Refunds. Refund requests are handled by Apple according to App Store policy. FORMA LABS does not directly process refunds for App Store purchases.
Price changes. We may change subscription prices with at least 30 days' notice. Your continued use after a price change constitutes acceptance.
You agree not to use the Service to:
We may suspend or terminate accounts that violate these rules.
You retain ownership of photos, notes, measurements, and other content you upload to the Service ("Your Content"). You grant FORMA LABS a worldwide, royalty-free license to store, process, display, and transmit Your Content solely for the purpose of operating the Service for you.
If you use features that share content with other users (for example, community challenges or activity feeds), you grant a limited license for that content to be displayed to those users as you direct.
You represent that Your Content does not infringe the rights of any third party and that you have all necessary rights to upload it.
Users under 18. Users under 18 may not upload photos, videos, or other personal media to FORMA LABS. Media upload features (including Progress photos, Progress videos, and inspiration photos) are unavailable on accounts under 18 and are enforced at the account level. This restriction cannot be lifted by the user, a supervising parent or legal guardian, or any other party.
The Service, including all software, designs, text, graphics, workout programs, and meal plans created by FORMA LABS, is owned by FORMA LABS and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission, except for your personal, non-commercial use of the Service as intended.
The Service uses third-party providers including, but not limited to, Supabase (data storage), RevenueCat (subscription management), PostHog (product analytics), Sentry (crash reporting), and large language model providers such as OpenAI, Anthropic, and Google (AI coaching features). By using the Service you acknowledge that your content may be processed by these providers strictly to deliver Service functionality.
AI-generated responses are provided as-is. They may be inaccurate, outdated, or inappropriate for your situation. Do not rely on AI output for medical, legal, financial, or other professional decisions.
We may suspend or terminate your access to the Service at any time if you violate these Terms, if required by law, or if continuing to provide the Service to you would harm FORMA LABS or other users. You may terminate at any time by deleting your account.
Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and dispute resolution) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FORMA LABS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INFORMATION OBTAINED THROUGH THE SERVICE WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMA LABS AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FORMA LABS IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) US $100.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions our liability is limited to the maximum extent permitted by law.
You agree to indemnify and hold harmless FORMA LABS from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of the rights of any third party.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Cumberland County, Pennsylvania, except as set out in Section 14 below.
Any dispute arising from or relating to the Service or these Terms will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except you may assert claims in small-claims court if your claims qualify. You and FORMA LABS waive any right to a jury trial and any right to bring or participate in a class action.
You may opt out of arbitration by emailing legal@formaapp.co with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opt-outs must include your full name and the email address on your account.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top and, for material changes, provide in-app notice or email notice at least 30 days in advance. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
